1. Agreement to Terms

By accessing or using the website www.alestemple.net (the “Website”), operated by alestemple.net (“we,” “us,” or “the Company”), you (“you” or “the User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use the Website.

These Terms are governed by the laws of Spain and the European Union, the EU Consumer Rights Directive 2011/83/EU, and any other applicable international laws. We reserve the right to amend these Terms at any time. Changes take effect upon publication on this page; your continued use of the Website constitutes acceptance of the revised Terms.

alestemple.net is a digital product store specialising in professional video editing templates and colour grading presets. We create and sell:

  • VEGAS Movie Studio project file templates

  • LUT (Look-Up Table) colour grading presets

3. Products and Services

3.1 Digital Products

All products sold through our Website are digital products — downloadable files delivered electronically. They include project files, template files, and LUT preset files. No physical goods are shipped.

3.2 Product Descriptions

We make every reasonable effort to ensure product descriptions, previews, and compatibility information are accurate. However, slight variations may occur due to differences in software versions, system configurations, or display settings. Product previews are for illustrative purposes and may include third-party media (stock footage, music) that is not included in the purchased template.

3.3 Software Requirements

Each product page specifies the required software version. It is your responsibility to verify that your software meets the stated requirements before purchasing. We cannot guarantee compatibility with software versions other than those explicitly listed.

4. Purchasing and Payment

4.1 Payment Processor

All purchases are processed by PayPal (including PayPal Checkout and Apple Pay via PayPal). By completing a purchase, you agree to PayPal’s User Agreement and Privacy Policy in addition to these Terms.

4.2 Payment Processing

PayPal processes all payments securely. We do not directly collect, store, or have access to your full payment card information. All payment data is handled by PayPal in accordance with PCI-DSS standards.

4.3 Pricing and Currency

All prices are listed in US Dollars (USD) unless otherwise indicated. Prices are inclusive of the product cost but may be subject to applicable VAT, sales tax, or other indirect taxes as required by law in your jurisdiction. Final prices, including any applicable taxes, are displayed at checkout before you confirm your purchase.

4.4 Delivery

Digital products are delivered instantly after successful payment. You will receive a download link by email. Download links remain active for the duration specified on the product page.

5. License and Intellectual Property

5.1 License Grant

Upon purchasing a digital product, you are granted a non-exclusive, non-transferable, royalty-free license to use the product in your personal and commercial video projects. This license permits you to:

  • Use the template or LUT preset in an unlimited number of your own video projects.
  • Modify the template to suit your project requirements.
  • Use the final rendered video output for commercial purposes (YouTube, social media, client work, broadcast, etc.).

5.2 Restrictions

You may not:

  • Redistribute, resell, sublicense, share, or give away the original template files or LUT files — whether modified or unmodified — to any third party.
  • Upload the template files to any file-sharing platform, torrent site, or stock marketplace.
  • Claim authorship or ownership of the original template design.
  • Include the unmodified template files as part of another product intended for resale or free distribution (e.g., a “template pack” or “preset collection”).
  • Use the products in any unlawful, defamatory, or otherwise prohibited manner.

5.3 Ownership

All intellectual property rights in the templates, designs, code, and LUT presets remain the exclusive property of alestemple.net. The purchase grants a license to use the product — it does not transfer ownership of the underlying intellectual property.

5.4 Website Content

All content on the Website — including text, graphics, images, blog articles, logos, and software — is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Website content without our prior written consent.

6. Refunds

Our refund policy is detailed on a separate page: Refund Policy. By purchasing a product, you acknowledge and agree to the terms set out in that policy.

7. Right of Withdrawal (EU Consumers)

Under Directive 2011/83/EU (Consumer Rights Directive) and Spanish law (Real Decreto Legislativo 1/2007), EU consumers normally have a 14-day right of withdrawal from online purchases. However, Article 16(m) of the Directive provides an exception for digital content:

“The supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and acknowledgement that they thereby lose their right of withdrawal.”

Because our products are digital files delivered immediately after purchase, by completing the checkout process and downloading the product, you expressly consent to the immediate delivery of the digital content and acknowledge that you lose your right of withdrawal once the download begins.

Notwithstanding the above, we offer a voluntary refund policy as described in our Refund Policy page.

8. User Conduct

When using the Website, you agree not to:

  • Violate any applicable local, national, or international law or regulation.
  • Infringe on the intellectual property rights of alestemple.net or any third party.
  • Attempt to gain unauthorised access to any part of the Website, its servers, or connected systems.
  • Use automated tools (bots, scrapers, crawlers) to access or extract data from the Website without our express written permission.
  • Introduce viruses, malware, or any other harmful code.
  • Interfere with the normal operation of the Website or the experience of other users.

9. Third-Party Links and Services

The Website may contain links to third-party websites, services, or resources (including but not limited to PayPal, YouTube, and external stock media platforms). These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party website. Your use of third-party services is governed by their own terms and policies.

10. Disclaimer of Warranties

The Website and all digital products are provided “as is” and “as available” without warranties of any kind, either express or implied, to the fullest extent permitted by law. We disclaim all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Website will be available at all times, uninterrupted, or error-free.
  • Digital products will be compatible with every software version or hardware configuration.
  • The results obtained from using the products will meet your specific expectations.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, alestemple.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or revenue, arising from or related to your use of (or inability to use) the Website or any digital product purchased through it.

Our total aggregate liability for any claims arising under or in connection with these Terms shall not exceed the total amount you paid to us for the specific product giving rise to the claim.

This limitation does not apply to any liability that cannot be excluded or limited under applicable EU/Spanish consumer protection law.

12. Indemnification

You agree to indemnify and hold harmless alestemple.net from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of any digital product, or your violation of any applicable law or third-party rights.

13. Privacy and Data Protection

Your personal data is processed in accordance with our Privacy Policy and our Cookie Policy. By using the Website, you acknowledge that you have read and understood both policies.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain and the applicable laws of the European Union.

In the event of a dispute, we encourage you to contact us first at info@alestemple.net to seek an amicable resolution. If no agreement can be reached:

  • EU consumers may submit a complaint through the EU Online Dispute Resolution (ODR) platform.
  • Disputes shall be submitted to the courts of Spain, unless mandatory consumer protection legislation in your country of residence grants you the right to bring proceedings in your local courts.

Note: Transactions processed by PayPal are also subject to PayPal’s User Agreement, which includes its own dispute resolution provisions.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be interpreted to reflect the original intent of the parties as closely as possible under applicable law.

16. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and alestemple.net regarding your use of the Website and supersede all prior agreements, understandings, and communications.
